GENERAL TERMS AND CONDITIONS OF ONLINE SALE

PREMISES
FIBRE operates the e-commerce website www.fibre.international (the “Website”), hosted on the Shopify platform.
These Terms govern the distance sale of products between FIBRE and the Consumer Buyer (a natural person acting for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity).
The Website is intended for a global audience. Specific clauses differ for EU and Non-EU markets (USA, Canada, UK) where required.
1. SUBJECT OF THE CONTRACT
1.1. Through this contract, FIBRE sells and the Buyer purchases, remotely, the tangible goods (garments, accessories) made available for sale on the Website.
1.2. The Buyer acknowledges that FIBRE products are crafted through artisanal and tailoring methods. Minor variations from the illustrative images (e.g., colour nuances, texture irregularities) are a natural feature of craftsmanship and shall not be considered defects.
2. ACCEPTANCE OF THE TERMS
2.1. Placing an order implies full knowledge and acceptance of these General Terms, the Privacy Policy, and the Cookie Policy.
2.2. For Buyers residing in the United States, acceptance also includes agreement to the Arbitration Clause and Class Action Waiver (see Art. 14).
3. PRICES, DUTIES & TAXES (IMPORTANT)
3.1. EU Customers: Prices are displayed in Euro (€) and include VAT according to the OSS rules applicable to the destination country.
3.2. Non-EU Customers (USA, Canada, UK, Switzerland, etc.):

Displayed prices may not include local taxes (Sales Tax, GST/HST/PST).

Sales occur under the Incoterm DAP / DDU (Delivered At Place / Duty Unpaid).

The total checkout amount covers product price and shipping fees only. Customs duties, import charges, and local taxes are the Buyer’s sole responsibility and must be paid to the carrier upon delivery.
Important:
If the Buyer refuses delivery due to unpaid duties, outbound and return shipping costs, as well as any duties advanced by the carrier, will be deducted from the refund.
4. CONCLUSION OF THE CONTRACT
4.1. The contract is deemed concluded when FIBRE sends the Buyer an Order Confirmation email, summarizing the terms, products, pricing, and selected payment method.
4.2. FIBRE reserves the right to refuse orders from users who do not provide adequate solvency guarantees or with whom disputes are ongoing.
5. PAYMENT METHODS
5.1. Payment may only be made using the secure methods supported by Shopify:

Credit/Debit Cards (Visa, Mastercard, Amex, Maestro)

PayPal, Apple Pay, Google Pay, Shop Pay

Installment payment systems (e.g., Klarna, Affirm, Scalapay) if available in the Buyer’s country
5.2. Charges are applied at the moment the order is confirmed. For Made-to-Order or Pre-Order items, advance payment is required to initiate production.
6. SHIPPING & DELIVERY
6.1. Shipments are handled via international couriers (e.g., DHL, UPS, FedEx). Delivery times (e.g., 2–4 business days) are indicative estimates and run from the moment the carrier collects the parcel.
6.2. Transfer of Risk:

EU Consumers: Risk of loss or damage transfers to the Buyer only when they (or a designated third party) physically acquire the goods.

USA/Canada Consumers: Shipment follows carrier rules; risk transfers according to the carrier’s terms, without prejudice to FIBRE’s support in case of loss.
7. RIGHT OF WITHDRAWAL & RETURN POLICY
7.1. Standard Right of Withdrawal: The Buyer may withdraw from the contract within 14 days from receipt of the product, without penalties and without providing a reason.
7.2. EXCLUSIONS (Personalized Products): Under Art. 59 of the EU Consumer Code and international retail practices (“Final Sale”), withdrawal is excluded for:

Tailor-made or clearly personalized garments (e.g., initials embroidery, requested alterations)

Sealed items not suitable for return for hygiene reasons (e.g., underwear, swimwear) if opened after delivery
7.3. Return Conditions: Items must be returned unworn (except for fitting), unwashed, undamaged, and with all original labels and security seals intact.
7.4. Return Costs: Return shipping costs are borne by the Buyer unless stated otherwise in specific promotions or in case of non-conformity.
7.5. Refunds: Refunds are issued within 14 days from receipt and inspection of the goods at our facilities, using the same payment method. Customs duties (for Non-EU returns) are non-refundable.
8. LEGAL WARRANTY OF CONFORMITY
8.1. Europe: Products are covered by a 24-month Legal Warranty of Conformity under the EU Consumer Code.
8.2. USA/Canada (Disclaimer of Warranties): TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRODUCTS ARE PROVIDED “AS IS.” FIBRE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
9. LIMITATION OF LIABILITY (USA/CANADA)
FIBRE shall not be liable for indirect, incidental, special, or consequential damages arising from use or inability to use the products. Liability shall not exceed the amount paid by the Buyer for the product.
10. PRIVACY & PERSONAL DATA
10.1. Personal data is processed in accordance with the GDPR for EU users and with CCPA/CPRA for US users. See the full Privacy Policy for details.
10.2. The Buyer declares that the data provided is true and accurate.
11. APPLICABLE LAW & JURISDICTION
11.1. EU Consumers: The contract is governed by Italian law. Jurisdiction lies with the court of the Consumer’s residence or domicile within the State.
11.2. Non-EU Consumers (excluding USA): Exclusive jurisdiction is the Court of Bolzano (Italy), unless otherwise required by mandatory local laws.
12. DISPUTE RESOLUTION (ODR)
EU consumers may use the European Commission’s ODR platform for out-of-court dispute resolution:

13. U.S. CUSTOMERS: ARBITRATION & CLASS ACTION WAIVER
13.1. Arbitration: For customers residing in the United States, any dispute arising from these Terms or the purchase of products shall be resolved exclusively through binding and confidential arbitration, waiving the right to bring an action before a judge or jury.
13.2. Class Action Waiver: The Buyer and FIBRE agree that any dispute resolution proceedings shall be conducted solely on an individual basis and not as a class, consolidated, or representative action.
